Welcome to the terms and conditions ("Terms") for the Hershey of the Month Club (the "Club"). By electing to join the Hershey of the Month Club, you acknowledge and agree that you have read these Terms, understand them, and agree to be legally bound by them. Please note that your use of the website ("Website") and the Club membership program is governed by the terms and conditions, privacy policy and all other applicable terms, conditions, limitations and requirements on the Website, all of which (as changed over time) are incorporated into these Terms. Your acceptance of these Terms creates a binding contract governing the terms of your membership in the Hershey of the Month Club and no other statements, representations, materials or related information will alter or amend these Terms, except as specifically referenced in these Terms and such revisions to these Terms instituted by The Hershey's Store in accordance with these Terms.

1) Hershey of the Month Overview back to top
The Hershey of the Month Club is a membership program where The Hershey Store will send to you a special confection gift every month. Gifts range from our World's Largest Kiss to a glass jar filled with Hershey's Assorted Mix. The subscription cost to you is $19.95 a month plus shipping and handling. The service is easy to use and customizable - you can cancel or make changes online whenever you need.

You always have complete control over your Hershey of the Month Club orders and we send an email reminder 10 days before each order ships. Changes to orders can be made any time within 24 hours of the next scheduled shipment date and you can skip your order or cancel by visiting the 'Hershey of the Month' section located within your account. If you do not cancel or change the order, The Hershey's Store will ship your order to you and your credit card on file in your My Account section of the Website will be charged for the cost of the order.

2) Membership Benefits back to top
Subject to such limitations and exceptions as applicable, including as otherwise set forth in these Terms, Hershey of the Month Club members are entitled to receive The Hershey's Store selected monthly chocolate (or other designated confections). Only individuals, and not corporations or businesses, are eligible to enroll as members. Only one person can be enrolled per Club membership subscription.

3) Monthly Chocolate Availability back to top
All Club members acknowledge that The Hershey's Store selected monthly chocolates & confections are limited in quantities and may not always be available at the time of shipment of your order. The Hershey's Store, in its sole discretion, may substitute other chocolate or confection for the Hershey of the Month Club item, without any adjustment or refund.

4) Fees back to top
All fees for Club membership and associated charges, such as shipping charges and other related charges, are automatically billed to your credit card on file in the Hershey of the Month section of your My Account page on the Website. Charges will be made to the credit card on file on a monthly basis, unless the Club member opts to skip a month.

While Hershey of the Month Club does not support gifting at this time, it is possible to purchase a Club membership subscription and cancel your membership after any number of orders, at your convenience and your discretion.

5) Subscription Terms, Changes and Renewal back to top
All Hershey of the Month Club memberships are on a month to month basis, and your membership automatically renews when each monthly order is placed. If you wish to cancel your membership, you must let us know three business days before shipment by making the appropriate selection in the Hershey of the Month section of your My Account page on the Website. The Hershey of the Month Club will send you an email reminder 10 days before each Hershey of the Month Club order. In addition, it is your responsibility to inform The Hershey's Store of any changes to your membership record and information. Changes to your membership account and information may be submitted online through the Hershey of the Month section on the My Account page on the Website. It may take up to 24 hours for any modifications or cancellations to be processed and updated in your account. If you wish to cancel your order after receiving your order confirmation email, please call customer service for assistance at 1-877-798-2226. If your order has shipped, you will be charged.

The Hershey's Store may terminate your membership in the Hershey of the Month Club at our discretion without notice. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.

6) Cool Ship back to top
In order to preserve the fine quality of your Hersheys products, and to ensure your utmost enjoyment of them, COOLSHIP shipping will be applied to all items that may be heat sensitive. We carefully pack your order into an insulated container with a reusable non-toxic liquid ice pack, which maintains optimal temperature during transit. Orders sent via COOLSHIP are shipped Monday through Wednesday, via 2nd Day Delivery, ensuring uninterrupted transport.

7) Damage During Shipment back to top
Conditions outside of the control of The Hershey's Store may adversely affect the chocolates/confections during shipment. If your order, at the time of delivery, is received damaged, spoiled, or otherwise defective, you may contact us regarding the damage and The Hershey's Store may, in its discretion and based on the particular condition of each such circumstance, send a replacement order in exchange, which is your sole and exclusive remedy for damaged or defective product.

8) Unavoidable Delay back to top
In the event of any circumstance outside of the control of The Hershey's Store that prevent, hinder, or delay The Hershey's Store from performing its obligations, the order will be held until The Hershey's Store can ship the order appropriately.

YOU UNDERSTAND AND AGREE THAT YOUR MEMBERSHIP IN THE HERSHEY OF THE MONTH CLUB, THE GOODS AND SERVICES PROVIDED BY THE HERSHEY'S STORE ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. THE HERSHEY'S STORE, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, INCLUDING THE WARRANTY OF MERCHANTABILITY AND THE WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. THE HERSHEY'S STORE WILL NOT BE LIABLE FOR ANY DAMAGES WHETHER DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, RESULTING FROM OR RELATED TO YOUR MEMBERSHIP IN THE CLUB. By joining the Club, you agree to defend, indemnify, and hold harmless The Hershey's Store and its affiliates, and their respective owners, officers, directors, employees, representatives and agents, from and against any and all losses, claims, damages, costs and expenses related to your misrepresentation as to any information provided by the Club, your breach of any of these Terms or any misuse of any goods, services or other benefits of Club membership.

10) Personal Information back to top
The Hershey's Store requires certain information from you to verify and administer your Club membership, and you agree that you have freely provided that information. Any personally identifying information you provide to The Hershey's Store or affiliated companies may be used for our internal business and for account management, customer service and related purposes, however, your personally identifying information will not be sold, licensed or disclosed to any parties other than our affiliates. You authorize The Hershey's Store to send your marketing communications and special offers as part of your membership benefits. To change your marketing preferences, please visit Email Subscription Settings in the My Account section on the Website. Notwithstanding any other statements or representations contained here or elsewhere, The Hershey's Store reserves its right to disclose any information in its possession if it is required to do so by law or legal process, or if it believes, in good faith, that such a disclosure is necessary to comply with law or legal processes, to defend its rights or to respond to an emergency situation. 11) Change in Terms back to top
These Terms shall remain in full force and effect while you are a member of the Hershey of the Month Club, and only The Hershey's Store may, in its sole discretion, modify the terms or add or delete any of the membership rules, conditions, benefits or rewards, in whole or in part. The Hershey's Store may make any such changes at any time for any or no reason, as determined in The Hershey's Store's sole discretion, with or without notice; provided, however, that any revision shall not apply to disputes that The Hershey's Store had notice on or before the date the change or revision is instituted. To review the most recent version of these terms, please regularly visit this page. If any change to these Terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR CLUB MEMBERSHIP.
